Orden JUS/3412/2008, de 17 de noviembre, por la que se publica la relación de plazas correspondientes al ámbito de Península y Baleares, que se ofrecen a los aspirantes aprobados en las pruebas selectivas para ingreso en el Cuerpo de Gestión Procesal y Administrativa de la Administración de Justicia, turno promoción interna, convocadas por Orden JUS/2976/2006, de 15 de septiembre.

De conformidad con lo establecido en la base decimoquinta de la Orden JUS/2544/2006, de 28 de julio, por la que se establecen las bases comunes que regirán los procesos selectivos para ingreso o acceso en los Cuerpos y Escalas de funcionarios al servicio de la Administración de Justicia («Boletín Oficial del Estado de 3 de agosto de 2006»), se resuelve:
Primero.-Hacer pública la relación de plazas desiertas en el ámbito territorial de Península y Baleares (Anexo I), que se ofrecen a los aspirantes que han superado el proceso selectivo para ingreso por el sistema general de promoción interna en el Cuerpo de Gestión Procesal y Administrativa convocado por Orden JUS/2976/2006, de 15 de septiembre.
Segundo.-Las solicitudes de destino de los aspirantes de este ámbito se dirigirán a la Dirección General de Relaciones con la Administración de Justicia.-Sección Concursos.-C/ San Bernardo, n.º 21, 28015 Madrid, en el plazo de diez días naturales, contados a partir del día siguiente al de la publicación de esta Orden en el Boletín Oficial del Estado.
Tercero.-Las solicitudes se formalizarán según modelo que aparece como anexo II de esta Orden de acuerdo con las siguientes instrucciones:
En el modelo de instancia podrán relacionarse hasta un máximo de 50 puestos de trabajo, indicando el órgano, la localidad y la provincia.
En caso de no corresponderle ninguno de los destinos especificados de esta forma, se seguirá el orden de preferencia por provincias que los interesados indiquen en el modelo de solicitud.
Dentro de cada provincia, los destinos serán adjudicados por el siguiente orden:

Tribunal Supremo y Órganos Centrales.

Tribunales Superiores de Justicia.
-
Audiencias Provinciales.
-
Fiscalías.
-
Institutos de Medicina Legal.
-
Decanatos y servicios comunes.
-
Juzgados de Instrucción.
-
Juzgados de lo Penal.
-
Juzgados de Vigilancia Penitenciaria.
-
Juzgados de Violencia sobre la Mujer.
-
Juzgados de Primera Instancia.
-
Juzgados de lo Mercantil.
-
Juzgados de lo Contencioso-Administrativo.
-
Juzgados de lo Social.
-
Juzgados de Primera Instancia e Instrucción.
-
Juzgados de Menores.
-
Juzgados de Paz.
Cuarto.-Una vez finalizado el curso selectivo y el período de prácticas y sumadas estas puntuaciones a la de la fase de concurso-oposición se procederá a la adjudicación según el orden obtenido en todo el proceso selectivo.
Quinto.-Ningún aspirante podrá anular ni modificar su solicitud una vez terminado el plazo de presentación de las mismas.
Sexto.-De no formular solicitud de plazas o no corresponderle ninguna de las solicitadas, se procederá a destinarle, con carácter forzoso, a cualquiera de las plazas no adjudicadas.
Séptimo.-La adjudicación de los destinos se hará con carácter forzoso, de acuerdo con el orden de puntuación obtenido en las pruebas selectivas en el ámbito de Península y Baleares.
Octavo.-Los destinos adjudicados tendrán carácter definitivo equivalente a todos los efectos a los obtenidos por concurso, sin que puedan participar en éste hasta tanto no hayan transcurrido dos años desde la fecha de la resolución en la que se les adjudique destino definitivo. Para el cómputo de los dos años se estará a lo establecido en el párrafo segundo del artículo 529.3 de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial.
Contra la presente Orden podrá interponerse recurso potestativo de reposición, en el plazo de un mes, ante el Ministerio de Justicia, o contencioso-administrativo ante los Juzgados Centrales de lo Contencioso-Administrativo, en el plazo de dos meses, a partir del día siguiente a su publicación en el «Boletín Oficial del Estado».
